ALIENS CONTROL

Foreigners in South Africa can be divided into two categories, namely: documented foreigners (legal foreigners) undocumented foreigners (illegal foreigners) Documented foreigners have applied through the proper channels and have been admitted into the country. Undocumented or illegal foreigners are those persons who enter or remain in the RSA and include any foreigner who enters the RSA at a place other than a designated port of entry e.g. border jumpers. Documented foreigners do, however, become illegal in the sense that they:
  • remain in the RSA without a valid residence permit
  • act in contravention of his/her residence permit
  • become prohibited persons whilst in the RSA
The prosecution and removal of illegal foreigners is a line function of the Department of Home Affairs and the responsibility of Immigration Officers at the various regional and district offices of the Department.
